By downloading, installing, or using NanoSpark ("the App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

2. Description of Service

NanoSpark is a private AI assistant that runs entirely on your device. The App uses Gemma, an open-source AI model developed by Google, to provide conversational AI capabilities without requiring an internet connection for AI processing.

3. AI Model Usage

3.1 Gemma Model

The App incorporates Google's Gemma 3n model, which is provided under the Gemma Terms of Use. By using this App, you also agree to comply with Google's Gemma Terms of Use available at: https://ai.google.dev/gemma/terms

3.2 Local Processing

All AI inference is performed locally on your device. Your conversations are never sent to external servers for AI processing.

3.3 AI Limitations

The AI may produce inaccurate, incomplete, or inappropriate responses
The AI does not have access to real-time information
Responses should not be relied upon for medical, legal, financial, or other professional advice
You are solely responsible for how you use and interpret AI-generated content

4. User Responsibilities

You agree to:

Use the App in compliance with all applicable laws
Not use the App to generate harmful, illegal, or abusive content
Not attempt to extract, reverse-engineer, or misuse the AI model
Not use the App for any purpose that violates Google's Gemma Terms of Use

5. Subscriptions and Purchases

5.1 Premium Features

The App offers premium features through in-app purchases or subscriptions.

5.2 Payment

All payments are processed through Apple App Store or Google Play Store. Payment terms are governed by the respective store's policies.

5.3 Refunds

Refund requests must be directed to Apple or Google according to their refund policies.

6. Intellectual Property

6.1 App Content

The App, excluding the Gemma model, is owned by Yando Pte. Ltd. and protected by intellectual property laws.

6.2 AI Model

Gemma is provided by Google under open-source licensing. Google and Gemma are trademarks of Google LLC.

6.3 User Content

You retain ownership of content you create using the App. However, you grant us no rights to your content as it remains stored locally on your device.

7. Privacy

Your use of the App is also governed by our Privacy Policy. Please review it to understand how we handle your information.

8. Disclaimers

The App is provided "as is" without warranties of any kind. We do not warrant that:

The App will meet your requirements
The App will be uninterrupted or error-free
AI responses will be accurate or appropriate
The App will be compatible with all devices

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

Any indirect, incidental, or consequential damages
Loss of data, profits, or business opportunities
Any damages resulting from AI-generated content
Any issues arising from the Gemma model

10. Indemnification

You agree to indemnify and hold harmless Yando Pte. Ltd. from any claims arising from:

Your use of the App
Your violation of these Terms
Your violation of any third-party rights

11. Termination

We may terminate or suspend your access to the App at any time, without notice, for any reason, including violation of these Terms.

12. Changes to Terms

We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by the laws of Singapore, without regard to conflict of law principles.
